RETURNS & REFUND POLICY 


1. INTRODUCTION & PURPOSE

Antiques & Vintages is committed to providing our customers with an authentic, transparent, and professional buying experience. Because each item in our collection is a one-of-a-kind antique or vintage piece with inherent age-related characteristics, our returns and refund policy is carefully designed to balance customer satisfaction with the unique nature of the goods we sell.

By completing a purchase with Antiques & Vintages — whether in-store, online, or via telephone — you acknowledge that you have read, understood, and agreed to the terms set out in this Policy.

This Policy is governed by the Consumer Protection Act 68 of 2008 (CPA) and, where applicable, the Electronic Communications and Transactions Act 25 of 2002 (ECT Act) of South Africa.


2. DEFINITIONS

For the purposes of this Policy, the following definitions apply:

  • “Antique” means any item that is at least 100 years old and is valued for its age, rarity, craftsmanship, or historical significance.
  • “Vintage” means any item that is between 20 and 99 years old and reflects the style, design, or cultural character of its era of production.
  • “Item” means any antique, vintage object, collectible, or decorative article offered for sale by Antiques & Vintages.
  • “Purchase” means any transaction in which an Item is sold, whether in-store, online, or via a remote sale channel.
  • “Customer” means any natural or juristic person who purchases or intends to purchase an Item from Antiques & Vintages.
  • “Condition Report” means a written document describing the physical state, known defects, repairs, restorations, and provenance of an Item.
  • “Cooling-off Period” means the five (5) business day period afforded to customers under Section 44 of the ECT Act for qualifying electronic purchases.

3. NATURE OF ANTIQUE & VINTAGE ITEMS

All customers must understand and accept the following characteristics intrinsic to antique and vintage items before completing a purchase:

3.1 Age-Related Wear & Patina All items are pre-owned and aged. Signs of wear, patina, crazing, fading, foxing, or minor surface marks are natural and expected. These characteristics are considered features — not defects — and do not constitute grounds for a return.

3.2 Prior Repairs & Restorations Many antique and vintage items have been professionally repaired or restored at some point in their history. All known repairs and restorations will be disclosed in the Condition Report available for each item. Unknown prior restorations that are subsequently discovered do not automatically entitle the customer to a refund.

3.3 Unique & Irreplaceable Nature Each item is one-of-a-kind. Colour variations between photographs and the physical item may exist due to lighting, camera settings, and screen calibration. Customers are encouraged to request additional photographs or a video walkthrough before purchasing.

3.4 No Two Items Are Identical Unless expressly stated, items are sold individually. A set listed as such will be described accordingly. Customers may not claim that a purchased piece differs from another they have viewed separately.

Note: We strongly encourage all customers — especially those purchasing remotely — to request a full Condition Report, multiple photographs, and measurements before committing to a purchase.


4. RETURN ELIGIBILITY

4.1 Items Eligible for Return Subject to the conditions in Section 5, a return may be accepted if:

  • The item received is materially and significantly different from the item described in the listing (beyond normal age-related variation).
  • The item arrives damaged in transit and such damage was caused by inadequate packaging on the part of Antiques & Vintages (proof of damage must be provided within 24 hours of delivery).
  • A significant and undisclosed defect exists that was not noted in the Condition Report and that materially affects the item’s value, structural integrity, or authenticity.
  • The item is proven to be a reproduction, forgery, or misattributed item where Antiques & Vintages made an explicit claim of authenticity.
  • The customer exercises their statutory Cooling-off Period right (online purchases only — see Section 7).

4.2 Items NOT Eligible for Return The following items and circumstances are excluded from the returns policy:

  • Items where the customer simply changed their mind after delivery (except under the statutory Cooling-off Period for online purchases).
  • Items purchased at a final sale, auction, clearance, or end-of-line price.
  • Items collected in-store, where the customer had the opportunity to physically inspect the item prior to purchase.
  • Items that have been altered, repaired, or restored by the customer or a third party after purchase.
  • Items with damage caused after delivery due to improper storage, handling, cleaning, or environmental factors.
  • Items where the customer was made aware of a specific defect at the time of purchase and agreed to purchase the item regardless.
  • Custom-sourced, commissioned, or specially ordered items.
  • Items returned without prior written authorisation from Antiques & Vintages.
  • Consumables, perishables, or items requiring ongoing maintenance that have been used.
  • Framed items where the customer requested or approved custom framing prior to purchase.

5. RETURN CONDITIONS & PROCESS

5.1 Return Window Return requests must be submitted within 7 (seven) calendar days of the date of delivery or collection. No returns will be accepted after this period, except in the case of a proven latent defect (see Section 6.2).

5.2 How to Initiate a Return To initiate a return, the customer must:

  1. Contact Antiques & Vintages in writing via email at info@antiques-vintages.co.za within 7 days of receiving the item.
  2. Include: full name, order reference number, item name/description, date of purchase, date of delivery, and a detailed description of the reason for the return.
  3. Attach clear photographic or video evidence of the issue(s) cited as grounds for the return.
  4. Await written authorisation — a Return Merchandise Authorisation (RMA) number — before returning the item. Items returned without an RMA number will not be accepted and may be returned to sender at the customer’s cost.

5.3 Condition of Returned Items Items must be returned in the exact condition in which they were received — unworn, unused, unaltered, and with all original accessories, certificates of authenticity, provenance documents, and packaging included. Items that are returned in a condition worse than when dispatched will not be refunded, or a deduction may be applied to the refund amount at Antiques & Vintages’ sole discretion.

5.4 Return Shipping Unless the return is due to our error (e.g. wrong item shipped, damage caused by our packaging), the customer is responsible for all return shipping costs. Items must be packed with appropriate archival-grade protective materials. Antiques & Vintages accepts no liability for items damaged or lost during return transit. We strongly recommend the customer use a tracked, insured courier service for all returns.

5.5 Assessment & Outcome Upon receipt of the returned item, Antiques & Vintages will inspect it within 5 (five) business days and notify the customer in writing of the outcome — either approval or rejection of the return. If approved, a refund or exchange will be processed as set out in Section 6.


6. REFUNDS & EXCHANGES

6.1 Approved Refunds Where a return is approved, the customer may elect to receive:

  • A full refund of the purchase price (excluding original delivery and insurance costs, unless the return is due to our error); or
  • A store credit to the equivalent value, valid for 12 months from the date of issue; or
  • An exchange for another item of equal or greater value (the customer pays any price difference).

Refunds will be processed via the original payment method within 10 (ten) business days of return approval. Antiques & Vintages is not liable for any bank processing delays beyond this period.

6.2 Latent Defects A latent defect is a material defect that was present at the time of sale but could not reasonably have been detected through ordinary inspection. In terms of the Consumer Protection Act, a customer may return an item with a latent defect within 6 (six) months of delivery, and may claim a repair, replacement, or refund.

Note: A latent defect does NOT include normal age-related deterioration, patina, prior undisclosed restorations discovered through informal research, or flaws noted in the Condition Report.

6.3 Non-Refundable Amounts The following costs are non-refundable in all circumstances:

  • Original delivery, courier, freight, and insurance charges.
  • Import duties, taxes, or customs charges incurred by the customer.
  • Authentication or independent appraisal fees incurred by the customer.
  • Any restoration or conservation work arranged by the customer after purchase.

7. ONLINE PURCHASES & STATUTORY COOLING-OFF PERIOD

Where an item is purchased electronically (via the Antiques & Vintages website or by email/remote agreement) and the customer is a natural person (not a business), Section 44 of the Electronic Communications and Transactions Act 25 of 2002 may apply.

7.1 Cooling-Off Period The customer may cancel the purchase within 5 (five) business days of receipt of the goods without penalty and without giving a reason. To exercise this right, the customer must notify Antiques & Vintages in writing at info@antiques-vintages.co.za within the Cooling-off Period.

7.2 Cooling-Off Exclusions The Cooling-off Period does NOT apply to:

  • Goods clearly personalised or custom-made for the customer.
  • Goods that cannot, by their nature, be returned — such as perishable or extremely fragile items.
  • Items purchased at an in-person auction or sale event, even if the initial enquiry was made electronically.
  • Items collected in-store, where physical inspection was possible.

7.3 Return Shipping Under Cooling-Off Where the customer cancels under the statutory Cooling-off Period, the customer is responsible for the cost of returning the goods. A refund of the purchase price will be issued within 30 days of cancellation, provided the item is returned in its original condition.


8. ITEMS DAMAGED IN TRANSIT

Antiques & Vintages takes great care in the professional packing of all items for dispatch. However, transit damage can occasionally occur. In the event that an item arrives damaged:

  • Do NOT accept the delivery if external packaging damage is clearly visible — note the damage on the courier’s delivery record and refuse receipt.
  • If damage is only discovered upon unpacking, contact Antiques & Vintages by email at info@antiques-vintages.co.za within 24 hours of delivery.
  • Photograph or film the packaging and the damaged item before disturbing the packaging further.
  • Retain all original packaging materials pending investigation, as they may be required by the courier’s insurance claims process.

Note: Failure to report transit damage within 24 hours of delivery may result in the claim being declined, as the courier’s insurer requires prompt notification. Antiques & Vintages accepts no liability for transit damage reported after this period.


9. AUTHENTICITY & PROVENANCE

9.1 Our Representations Antiques & Vintages makes reasonable efforts to verify the age, origin, and authenticity of all items. Where we make an explicit written representation as to an item’s authenticity, period, maker, or provenance, we stand behind that representation.

9.2 Misattribution If an item is subsequently proven by a recognised expert or institution to be misattributed — for example, identified as a reproduction when sold as an original — the customer may return the item for a full refund within 30 days of obtaining such expert opinion, provided the expert report is submitted in writing.

9.3 Customer’s Own Research Antiques & Vintages is not responsible for the outcome of independent research undertaken by customers after purchase that contradicts our listing description, unless a formal independent expert assessment substantiates a material misrepresentation.


10. IN-STORE PURCHASES

Customers who purchase items in-store and have had the opportunity to physically examine the item before purchase waive their right to return the item on the grounds of condition, appearance, or characteristics that were visible or disclosed at the time of sale.

In-store purchases are therefore considered final unless:

  • A latent defect (as defined in Section 6.2) is subsequently discovered; or
  • The item was misrepresented in a material way at the time of sale.

11. LAYAWAY, DEPOSITS & RESERVED ITEMS

11.1 Deposits A deposit paid to reserve or hold an item is non-refundable if the customer subsequently cancels the reservation, unless the reason for cancellation is attributable to Antiques & Vintages (e.g. the item is no longer available as described).

11.2 Layaway Payments Items held under a layaway arrangement must be paid in full within the agreed layaway period. If the customer cancels a layaway arrangement after committing, Antiques & Vintages reserves the right to retain a reasonable portion of payments made to cover storage, administration, and any loss of sale opportunity, as agreed in writing at the time the layaway arrangement is entered into.

11.3 Failed Layaway Completion If the customer fails to complete payment within the agreed period and no extension has been granted in writing, the item may be returned to active sale and any deposits may be forfeited as set out in the layaway agreement.


12. CONSIGNMENT & THIRD-PARTY ITEMS

Certain items sold by Antiques & Vintages are offered on consignment from third-party sellers. In all such cases, Antiques & Vintages acts as the selling agent. The returns policy set out in this document applies equally to consignment items. Antiques & Vintages will liaise with the consignor where necessary in the event of a valid return or refund claim.


13. DISPUTE RESOLUTION

13.1 Internal Resolution In the event of any dispute arising from a return or refund request, the customer is encouraged to first attempt to resolve the matter by contacting Antiques & Vintages in writing at info@antiques-vintages.co.za. We aim to acknowledge all written complaints within 2 business days and provide a substantive response within 7 business days.

13.2 External Bodies Should the internal resolution process fail to produce a satisfactory outcome, the customer may refer the matter to the National Consumer Commission (NCC) or any other competent consumer authority in accordance with the Consumer Protection Act 68 of 2008.


14. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Antiques & Vintages’ liability arising from or related to any purchase, return, or refund shall not exceed the original purchase price paid by the customer for the item in question.

Antiques & Vintages shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of investment value, emotional distress, loss of anticipated appreciation, or the cost of obtaining a replacement item elsewhere.


15. POLICY AMENDMENTS

Antiques & Vintages reserves the right to amend, update, or replace this Policy at any time. The current version of the Policy will always be available upon request and will apply to all purchases made from the effective date shown at the top of the document. Amendments will not affect purchases made prior to the amended Policy’s effective date.


16. GOVERNING LAW & JURISDICTION

This Policy is governed by the laws of the Republic of South Africa. Any disputes that cannot be resolved amicably shall be subject to the jurisdiction of the South African courts.

If the customer cancels a layaway arrangement after committing, Antiques & Vintages reserves the right to retain a reasonable portion of payments made to cover storage, administration, and any loss of sale opportunity, as agreed in writing at the time the layaway arrangement is entered into.

12. CONSIGNMENT & THIRD-PARTY ITEMS

13. DISPUTE RESOLUTION

We aim to acknowledge all written complaints within 2 business days and provide a substantive response within 7 business days.

13.2 External Bodies Should the internal resolution process fail to produce a satisfactory outcome, the customer may refer the matter to the National Consumer Commission (NCC) or any other competent consumer authority in accordance with the Consumer Protection Act 68 of 2008.


14. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Antiques & Vintages’ liability arising from or related to any purchase, return, or refund shall not exceed the original purchase price paid by the customer for the item in question.

Antiques & Vintages shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of investment value, emotional distress, loss of anticipated appreciation, or the cost of obtaining a replacement item elsewhere.


15. POLICY AMENDMENTS

Antiques & Vintages reserves the right to amend, update, or replace this Policy at any time. The current version of the Policy will always be available upon request and will apply to all purchases made from the effective date shown at the top of the document. Amendments will not affect purchases made prior to the amended Policy’s effective date.


16. GOVERNING LAW & JURISDICTION

This Policy is governed by the laws of the Republic of South Africa. Any disputes that cannot be resolved amicably shall be subject to the jurisdiction of the South African courts.
